Terms and Conditions

Welcome to PhoneCurfew. These Terms and Conditions ("Terms") govern your use of the PhoneCurfew mobile application ("the App") provided by Gigadroid Technologies ("we," "our," or "us"). By downloading, installing, or using PhoneCurfew, you agree to these Terms. If you do not agree, please do not use the App.
1. Eligibility
You must be at least 16 years old to use PhoneCurfew. By using the App, you confirm that you meet this age requirement.
2. Description of the Service
PhoneCurfew is a mobile application that helps you build healthier phone habits by using Apple's Screen Time and Family Controls APIs to schedule app restrictions and bedtime cutoffs.
PhoneCurfew is a lifestyle and habit-building tool. It is not a medical device, not a substitute for professional medical or psychological advice, and not intended to diagnose, treat, cure, or prevent any condition, including sleep disorders. If you have concerns about your sleep or phone use, please consult a qualified healthcare professional.
3. Subscriptions and Auto-Renewal
Some features of PhoneCurfew are available only through a paid subscription, purchased through Apple's App Store.
- Subscription length, price per period, and free trial details are shown clearly on the paywall before purchase, and again in the App Store before you confirm.
- Payment is charged to your Apple ID at confirmation of purchase.
- Your subscription automatically renews unless auto-renewal is turned off at least 24 hours before the end of the current period.
- Your Apple ID account is charged for renewal within 24 hours prior to the end of the current period at the price of the selected subscription.
- You can manage your subscription and turn off auto-renewal at any time from your Apple ID Account Settings after purchase.
- Any unused portion of a free trial period is forfeited when you purchase a subscription.
4. Free Trial
PhoneCurfew may offer a free trial. The duration and terms of the trial are shown on the paywall before you opt in. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription at the price disclosed at purchase.
5. Refunds
All purchases of PhoneCurfew subscriptions are processed by Apple, and all refund requests must be submitted to Apple. The Developer does not have the ability to issue refunds.
To request a refund, visit https://reportaproblem.apple.com and sign in with the Apple ID used for the purchase. Apple reviews refund requests on a case-by-case basis according to its own policies; the Developer has no influence over Apple's decision.
Cancelling your subscription does not automatically trigger a refund. Cancellation takes effect at the end of the current billing period, and you retain access to premium features until that date. Partial billing periods are not refunded.
Free trial: You will not be charged during the 7-day free trial. If you cancel before the trial ends, you will not be charged and no refund is necessary. If you do not cancel before the trial ends, your selected subscription begins and your Apple ID is charged.
EU Right of Withdrawal: If you are a consumer in the European Union, you normally have a 14-day right of withdrawal for digital services under EU consumer law. By starting to use PhoneCurfew immediately after purchase, you expressly consent to the supply of the digital service beginning before the end of the 14-day withdrawal period and acknowledge that you thereby lose your right of withdrawal once the service has been fully supplied. Where local consumer law grants additional non-waivable rights, those rights remain unaffected.
6. Consent to Share Consumption Data with Apple
By using the App and making in-app purchases, you consent to our sharing of data regarding your subscription and App usage with Apple as part of refund request reviews. This information may include details about how you have accessed and used purchased features. The purpose is to help Apple make informed decisions on refund requests. We share this data only as necessary to process such requests and in compliance with Apple's policies.
7. License to Use the App
We grant you a personal, non-exclusive, non-transferable, revocable license to use PhoneCurfew on Apple devices you own or control, subject to these Terms and Apple's standard Licensed Application End User License Agreement (https://www.apple.com/legal/internet-services/itunes/dev/stdeula/).
You agree not to:
- Reverse engineer, decompile, or attempt to extract the source code of the App
- Use the App in a manner that violates any applicable law or regulation
- Use the App in a way that disrupts, damages, or impairs the App
- Sell, lease, sublicense, or redistribute the App
8. Intellectual Property
PhoneCurfew, including its design, code, content, and trademarks, is the intellectual property of Gigadroid Technologies. These Terms do not grant you any ownership rights in the App. All rights not expressly granted are reserved.
9. Disclaimers
The App is provided on an "as is" and "as available" basis, without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of viruses.
10. Limitation of Liability
To the fullest extent permitted by law, Gigadroid Technologies will not be liable for any indirect, incidental, consequential, special, or punitive damages arising from or related to your use of the App, including but not limited to loss of data, loss of profits, or other intangible losses.
Our total liability for any direct damages arising from these Terms or your use of the App is limited to the amount you have paid us in the twelve months preceding the event giving rise to the claim.
11. Privacy
Your privacy is important to us. Please see our Privacy Policy at igorstevanovic.com/phonecurfew/privacy-policy for information about how we collect, use, and protect your data.
12. Modifications to Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated Effective Date. Your continued use of the App after changes are posted constitutes acceptance of the revised Terms.
13. Governing Law and Disputes
These Terms are governed by the laws of the Netherlands. Any disputes arising from your use of the App will be resolved by the competent Dutch courts, except where mandatory consumer protection laws of your country of residence provide otherwise.
14. Apple-Specific Terms
The following terms apply because PhoneCurfew is distributed through the Apple App Store. In the event of any conflict between these Apple-specific terms and the rest of these Terms, the Apple-specific terms control with respect to the subject matter they address.
1. Acknowledgment. You and the Developer acknowledge that these Terms are concluded between you and the Developer only, and not with Apple Inc. ("Apple"). Apple is not responsible for PhoneCurfew or its content. To the extent these Terms provide for usage rules for PhoneCurfew that are less restrictive or conflict with the Apple Media Services Terms and Conditions, the more restrictive or conflicting Apple term applies.
2. Scope of License. The license granted to you in these Terms is limited to a non-transferable license to use PhoneCurfew on any Apple-branded device that you own or control, and as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, including with respect to Family Sharing.
3. Maintenance and Support. The Developer, not Apple, is solely responsible for providing any maintenance and support services for PhoneCurfew. You and the Developer acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to PhoneCurfew.
4. Warranty. The Developer is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of PhoneCurfew to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for PhoneCurfew to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to PhoneCurfew. Any claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be the sole responsibility of the Developer.
5. Product Claims. The Developer, not Apple, is responsible for addressing any claims by you or any third party relating to PhoneCurfew or your possession and use of it, including but not limited to: (i) product liability claims; (ii) any claim that PhoneCurfew fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation, including in connection with PhoneCurfew's use of the HealthKit and HomeKit frameworks, if applicable.
6. Intellectual Property Rights. You and the Developer acknowledge that, in the event of any third party claim that PhoneCurfew or your possession and use of it infringes that third party's intellectual property rights, the Developer, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
7. Legal Compliance. You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

9. Third Party Terms of Agreement. You must comply with applicable third party terms of agreement when using PhoneCurfew (for example, your wireless data plan terms).
10. Third Party Beneficiary. You and the Developer acknowledge and agree that Apple, and Apple's subsidiaries, are third party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third party beneficiary thereof.
